Right of access to information

Information is any data piece owned by a public authority in the form of a document, record, dossier or register, regardless of the manner in which it is presented (written, drawn, printed, recorded, magnetic, optical, electronic or other record), which the authority has created itself or in cooperation with other authorities or received from another person, and which was created within the scope or in connection with the organization and work of the public authority.

The user has the right to access the information by submitting a request. The written request shall contain: the name and registered office of the public authority to which the request is submitted, data that are important for identifying the requested information, name and surname and address of the natural person of the applicant and the company or name of the legal person and its registered office.

There are no additional fees with the form when submitting your application.

The applicant is not obliged to state the reasons for requesting access to information or to invoke the application of the Act on Access to Information.

Based on the request for access to information, the public authority will make a decision no later than 15 days from the date of submission of a complete request.

In the event of an incomplete or incomprehensible request, the public authority shall without delay invite the applicant to correct it within five days from the date of receipt of the call for correction. If the applicant does not properly correct the request, and it is not possible to determine with certainty what the requested information is based on the submitted information, the public authority will dismiss the request by a decision.

If the user deems the information provided on the basis of the request inaccurate or incomplete, they may request its correction or amendment within 15 days from the date of obtaining the information. The public authority is obliged to decide on the request for supplementation or correction of information within 15 days from the date of receipt of the request.

HŽ Putnički prijevoz d.o.o. is entitled to reimbursement of actual material costs from the applicant in connection with the provision and delivery of the requested information according to the criteria that can be found here, as prescribed by the Information Commissioner.

The right to reuse information is governed by Article 27 of the Act on Access to Information (OG 25/13, 85/15).

Every user has the right to reuse information for commercial or non-commercial purposes in accordance with the provisions of this Act.

For the purpose of reuse, public authorities are not obliged to create, adapt or extract pieces of information if this requires a disproportionate use of time or resources, nor can public authorities be required to continue updating, upgrading and storing information for the purpose of reuse.
Other provisions of this Act shall apply appropriately to matters not specifically regulated by this Article.

Pursuant to Article 17 of the Act amending and supplementing the Act on Access to Information (OG 85/15), in the request for reuse of information, except for the data referred to in Article 18, paragraph 3 of the Act on Access to Information, the applicant must also indicate:

1) information they want to reuse;
2) the form and manner in which they wish to receive the content of the requested information;
3) the purpose for which they wish to reuse the information (commercial or non-commercial purpose).
